1. Agreement to Terms

By accessing or using AFXO services ("Services") provided by Digitalyze Labs Ltd. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

2. Description of Services

AFXO provides foreign exchange oracle infrastructure, including but not limited to:

• FX rate data aggregation and delivery via API
• On-chain oracle smart contracts for blockchain integration
• Risk intelligence and confidence scoring
• Historical data access and analytics

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Account Registration

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of the Services
• Reverse engineer, decompile, or disassemble any aspect of the Services
• Resell, redistribute, or sublicense the Services without our written consent
• Use data obtained from the Services in a manner that competes directly with our Services
• Scrape or collect data from public pages for commercial purposes

6. Data Usage and Limitations

Important: FX data provided through our Services is for informational purposes only. You acknowledge and agree that:

• Public indicative rates are delayed and not suitable for trading or settlement
• Production-grade data requires an authenticated API subscription
• We do not guarantee the accuracy, completeness, or timeliness of any data
• You are solely responsible for your use of the data and any decisions made based on it
• AFXO is a data infrastructure provider, not a financial advisor or broker

7. Subscription and Payment

Certain Services require a paid subscription. By subscribing, you agree to pay all applicable fees as described in your subscription plan. Fees are non-refundable except as required by law or as explicitly stated in your agreement. We reserve the right to modify pricing with 30 days' notice.

8. Intellectual Property

All content, features, and functionality of the Services, including but not limited to software, algorithms, data aggregation methods, text, graphics, logos, and trademarks, are owned by Digitalyze Labs Ltd. and are protected by international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITALYZE LABS LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Digitalyze Labs Ltd. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Services or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.
